but that's because the construction quipment is moving and the people are just getting back on the roadway, so no need for an alternate. we're going to track this and see how things clear up. >> thank you. we also have a surprising twist in the bryan stow case. nbc bay area has confirmed that los angeles police have arrested two new suspects in the case. another suspect has been in custody for months but now it appears he may not be connected to that case at all. "today in the bay's" marla tellez is live outside san francisco general hospital with more. good morning. >> reporter: good morning, laura. no doubt about it, this story has really gripped the bay area since it first broke. bryan stow nearly beaten to death almost four months ago. last night nbc bay area confirmed with the los angeles police department they have arrested two new suspects in his beating. who these suspects are and what led to their arrest, well, we are still waiting to learn those

details. in the meantime, the big question remains what does this mean for giovanni ramirez, the 31-year-old man who the lapd arrested in may, calling him the main suspect ever since. though ramirez is currently serving a 10-month prison sentence for an unrelated parole violation, his attorney is celebrating this latest development. all along attorney ramirez has told lapd his client was not even at dodger stadium the day of march 31st, that was when stow was beaten in the parking lot. >> i guess i'm being forced to take the high road and credit the lapd for continuing the investigation. i think that they made the right move in switching rhd. i think we're seeing the product of that move. >> since the lapd named ramirez as the primary suspect they have been fairly tight-lipped never

citing evidence that linked ramirez to stow. to be clear ramirez was never officially charged with the stow beating. i called the los angeles police department to ask them if they are planning to hold a press conference about this. the woman told me, no, not today but no doubt the l.a. police chief is under pressure. he is going to have to give a statement sooner than later. for bryan stow, the giant fan has been here at sf general more than two months, his condition has gone from critical to serious i. know you have more information about his condition for us. >> we do. the family of bryan stow says he's doing better and is alert. they posted this on the support for stow website. as of last night brian had both eyes open, his right hand was trying to give a thumbs up or hold up two fingers. he closed his eyes and opened.

shooter. >> nearly two months since michelle le disappeared and tonight another fund-raiser to help raise money for the effort to find her. it begins at 9:30 at the icon ultra lounge. the event is presented by san francisco state's beta phi sorority. she disappeared may 27 on a break from her shift. hayward police classified the case as a homicide. the family says they will not accept that without definite evidence. >> dozens of people cited and released after a protest outside a downtown san francisco hotel. hundreds gathered the grand hyatt last night to protest what they call unfair business practices. they say the hyatt is eliminating jobs and increasing the work load for employees. workers have not had a labor contract since 2009, more than 80 demonstrators were cited for

amplifying ridge. through the weekend it continues to get closer and closer to us. that means as we head through monday, tuesday, wednesday, mid-90s back on the temperature map. even the triple digits which we stayed away from almost the entire month. 59 in sunnyvale, 55 san francisco, 54 in santa rosa. toasty in the east bay yesterday. today much cooler weather for you. 86 degrees in livermore. 88 in fairfield and 86 in concord. even the south bay valleys will be comfortable as we head thorough the afternoon. daytime highs at 4:00 p.m., it might be warm at that time for a run in places like san jose 85 but it's cool, you can breathe in that clean air, onshore flow keeping our air quality good. towards the weekend, 80 on sunday. that's the best day for outdoor plans. sunshine on sunday. then we jump to 90 degrees monday, up to 95 wednesday and the triple digits in the warmest spots. back to you. >> looks like we'll enjoy the

>> welcome back. a good friday morning to you. what a beautiful live look outside. the sheen of the water by the bay bridge. traffic appears to be moving smoothly through this shot at least right now. in fact, drivers traveling on a major freeway flew the north bay this morning, however, should be aware of a shift in their commute. caltrans says starting today drivers headed north on 101 and rohnert will be directed on a new overpass. northbound shifted on the new portion of that overpass on the east side of the highway near wilfred avenue. the shift is the first of a two-part project to replace an older overpass. busy morning when it comes to the commute.

i want to check it with mike. >> good morning. we expected, well, we have a shift. we expected more problems through the south bay. the good news first to the south bay maps. tuning tine hear if the construction has cleared. it has from 101. you have lanes open as you pass under the tully overcrossing. things were crazy. we thought it was going to be extended longer than they thought but it picked up just about 5:00 this morning. a note, though, that continuing tonight action tomorrow night and sunday night you have overnight closures as well so. capital expressway is a good alternate. it's a simple one. between 101 and 680. the posted one on capital to the other side of the freeway along mclaughlin. this is the construction that went on overnight and that's why they have to close it. a huge project continues and we've seen these on weekends overnight, a couple times earlier. i wanted to give you that note again. we'll take you back to the maps and show you the approach to the bay bridge. the travel times looking good, no major delays. the backup through antioch

hasn't formed. we expect it to form later on a friday, 5:45 we should see slowing. and a look at the upper deck. you showed this shot but yes, in the middle of the screen the headlights are clustering at the toll plaza. that's as they come together toward the incline and the smooth drive you see in the foreground. the construction zone on the lower deck is picking up as you head toward treasure island. >> a lot of people up early. former governor arnold schwarzenegger is asking for help from the court this morning. according to papers filed in divorce court, he is requesting that no spousal support be awarded to maria shriver his wife of 25 years. he also asks that attorney fees and legal costs be jointly paid. the couple does not have a prenup you'll agreement which nenes under california law shriver is entitled to half of schwarzenegger's assets massachusetts ria shriver filed for divorce after the former governor acknowledged fathering

jet stream has brought about another cooldown for us. i'll let you know which day is the best for outdoor plans coming up this weekend. right now, it's not really friday light this morning, mike. you're pretty ef busy this morning. >> not on the incident reports, christina. we have a lighter volume right now in the south bay and folks tuning in now, wanted to know about this, the closure for highway 101. we had this overnight closure flew the weekend. i got my eyes on this. this might be what you're talking about. we see slow spots. i'll explain about the north bay slow in a second. >> thank you. we also have new developments this morning in the bryan stow beating investigation. we've confirmed with the l.a. police department two new suspects have been arrested. the arrest could clear giovanni ramirez arrested in may in connection with that beating. we'll have a live report from los angeles with the latest coming up in about ten minutes. >> still no word on how a 14-year-old santa rosa girl died

at her own slumber party. the sheriff's office says an autopsy of the girl turned up no definitive cause of death. she was hosting a sleepover with three friends when the girls found a bottle of vodka in a cup board and decided to start drinking. the girls told deputies they think she drank more than they did. officials are still waiting for a toxicology report. >> we're following up on two fires that burned nearly 550 acres last night along the altamont pass. christie smith is live in livermore where firefighters are certainly keeping a close eye on the fire, watching for flare-ups. good morning. >> reporter: good morning to you. happy friday. that's exactly right. right now crews are scattered throughout the hills here trying to make sure that this fire doesn't flare up again after it burned more than 500 acres of grass. it's quite windy now. we're near the wind mills.

here's what we know. i spoke with cal fire. they say this fire is called the flynn fire. it started around 9:30 last night, moved through the hills of grass, driven by the winds, over 20 miles an hour. the fire is now basically stopped or over 80% contained. and this follows another fire, about 50 acres, starmted at 7:30 along 580 which snarled traffic. crews telling me these are not related. but speaking of traffic this morning, this fire near patterson pass road has that closed between cross and midway because of all of the equipment out here at least 25 trucks. at least it will be closed through the morning, possibly later. some people i'm told use it as an alternate from the mountain house area, so certainly something to keep in mind. the cause of both fires still under investigation this morning. reporting live near the altamont pass, christie smith and bay

area news. >> beautiful sunrise behind you. thank you for the update. this morning at least one person is in the hospital with severe burns after flames ripped through a home in oakley. firefighters say that fire started a few minutes before 2:30 this morning at fourth and main streets. so far no word on the cause of the fire. >> 5:32. police officers and deputies in the east bay are teaming up to crack down on gun violence and gang activity. police and the sheriff's office have joined together to create a gang task force t the goal to disrupt the cycle of retaliation between gangs and street groups. eight people have died in richmond this month alone. police officers and deputies will patrol together to pinpoint problem areas in richmond. they will work to investigate crimes, share information and strategize. >> two former richmond police

officers will go to trial danny harris jr. is accused of buying three guns from a dealer for the minors, and lying about who would use them. harris and former officer raymond thomas jr. are also accused of setting up a sting operation where the teens would be caught with the guns. they were charged with conspi conspiring to deceive authorities and obstruction. both former officers are set to be in court next month. >> 5:33. time to check the forecast with christina loren. i could tell it was cooler out. >> yeah. it's refreshing when you walk out especially in the east bay and the south bay. you live in those valleys you know how hot it was yesterday. today we're looking much better as onshore flow picks back up. you saw that live picture of the bay bridge. you can see it from the top to bottom this morning. that won't last. through 6:00, 7:00, we're going to lose a lot of this visibility. right now headed out the front

door you're getting the best clear drive of the morning. what you can expect later on. throughout afternoon high pressure will start to move closer to the bay area but it's not going to bring our temperatures up until monday so we'll get a nice weekend, sunday the best for outdoor activities. that's where we expect the most sunshine. you're on the way to about 82 degrees up in the north bay wine country. will be gorgeous. 85 in san jose and 86 down from about 96 in livermore. got the 7-day outlook coming up. >> a good change, i showed you this a few minutes ago but we'll go back. 101 southbound between highway 37 and san pedro road, typical construction spots restricting flow from two lanes to one. see awe red. increased volume caused increased slowdowns. you have speeds around 40 miles per hour down to the richmond/san rafael bridge. more construction zones clear

up. approaching that bay bay bridge smooth flow as well as off of 580. that's the richmond bridge. an 18-minute drive to the toll plaza. no delays, for highway 24. antioch on the right, holding up. 55 registering and that could be a sign for slowing but it typically is about 55 much of the morning in that area until a slowdown starts near concord. 680, spots with construction, the off ramp cleared. nice out of livermore for 580, 14 minutes. as i checked, christie was talking about this. chp says you can get through the area, there is a lot of fire equipment. you might want to avoid patterson pass and nbc 1097. they are on scene. >> they keep track of everything. >> they are watching you. >> it's a selfless act caught on

with president obama. news reports are that they are going to certify that "don't ask, don't tell," law of the land for the last 17 years, can be repealed without harming u.s. security. when president obama signs off on that, that starts a 60-day countdown clock toward the final repeal of "don't ask, don't tell." so, if everything happened today, that means "don't ask, don't tell" would be gone sometime in late september. the court challenges of course would end up being moot. the pentagon would be prohibited from doing anything to investigate or discipline soldiers in the military from talking about being gay, but there are still some issues that will have to be worked out that may go way beyond september, specifically benefits for same-sex couples. back to you. >> thank you so much, brian. this morning san francisco police are looking for a gun, the gun they believe fired the shot that killed a 19-year-old suspect in the bay view

district. new ballistics evidence suggests that the fatal bullet was not from a police officer. damian trujillo is live in san francisco and joins us with an update. good morning. >> reporter: good morning. this sign here at the scene of the shooting explains a sentiment here in the bayview. you should not pay for muni with your life. now this revelation that kenneth harding may have shot himself according to the medical examiner is sure to stir up more controversy in the bay view. so far one man dead and the gun apparently used to kill him missing. we're going to show you video that is from youtube. it apparently shows a man in a hooded sweatshirt picking up a gun. police are looking for that man and the gun that was lying on the muni plaza. here in the bay view. they are offering a $1,000 reward. after a gun battle with police over the weekend, residents became enraged, getting confrontational with the police

chief over the shooting. but the chief medical examiner and police staff insist police did not fire the gun that killed kenneth harding. >> personally reviewed the analysis, i can say that the bullet is a 380/ .9 mm caliber and not consistent with department-issued duty ammunition. furthermore, the bullet could not have been fired from any department issued firearm. >> reporter: that's a very important fact from the investigators. 380 caliber handgun or bullet is what was found in the body body of ken harding. police are issued 40 caliber handguns. that's the difference that the medical examiner is trying the to make. they did find a bullet that is a .380 caliber in the pocket of ken harding. no matter how you explain this to the residents here you get the feeling you're going to have

a hard time explaining to them or convincing them that kenneth harding may have shot himself. >> thank you. it's 5:42. los angeles police confirming to us this morning that officers have arrested two new suspects in the brutal beating of giants fan bryan stow. it's a stunning moment for the stow family. for the family of the man initially arrested, suspected of the attack, has to be a sense of relief. john cadiz klemack is live in los angeles with a new twist in the case. good morning, john. >> reporter: good morning, laura. big new twist in this case. i don't know if you recall a few weeks ago we heard from the police chief here who admitted it was possible that this giovanni ramirez may not be the prime suspect. of course now we've seen what's happening now we have this to talk about. ramirez almost exonerated now.

apparently not going to be charged with the beating of bryan stow. he has been in custody since the 22nd of may. his attorney doing so as well. we confirmed that yesterday lapd arrested two different men in records to this. his attorney telling us that since the beginning he as believed that lapd has had the wrong guy. >> forced to take the high road and dread lapd for continuing the investigation. i think they made the right move in switching rhd. they had to bring in and i think we're seeing the product of that move. >> reporter: of course, brian remains in the hospital there in the bay area. of course you guys are following that and we're following it as well. we also know that lap -- admitted to us they have surveillance video they have been keeping an eye on. from before the beating happened. they claim in that they see two
